фин. проблема общего фонда [пула\]* (при попытке реструктуризации компании: проблема, связанная с тем, что даже в том случае, когда стоимость предприятия как действующей хозяйственной единицы больше его стоимости как совокупности активов, найдутся кредиторы, которые будут стремиться воспользоваться своим правом реализации заложенных активов (так как это позволит им немедленно и в полном объеме получить причитающиеся им суммы), а использование отдельными кредиторами своего права на отчуждение активов начнет снижать стоимость фирмы в целом и уменьшать шансы других кредиторов получить даже часть причитающихся им сумм, поэтому и другие кредиторы (понимающие, что стоимость действующего предприятия была бы выше) будут вынуждены последовать примеру кредиторов, отчуждающих имущество; в результате выработать план реструктуризации не удастся, а некоторые кредиторы не смогут получить причитающиеся им суммы; в американском законодательстве для защиты от подобных ситуаций используется положение, запрещающее отдельным кредиторам после начала официальной процедуры банкротства подавать дополнительные индивидуальные иски и в индивидуальном порядке отчуждать часть имущества банкрота)See: -
